Age Assurance & Underage Policy

Every user must complete age assurance before accessing any chat, image, voice, video or other content on Fiara, including any trial or guest access. Self-declaration, ticking a box or entering a date of birth is not accepted as age assurance.
Signing in with a Google or X account is not age assurance and does not replace it: every user must still complete age assurance before accessing any content.

Age assurance is carried out by Incode, an independent provider, using facial age estimation with liveness detection. If the result is inconclusive or close to the age threshold, you must verify with a government-issued identity document. Digital Twin creators and Creators must complete full identity verification (Section 4).

Your data goes directly to Incode. Fiara receives and stores only the result (pass or fail), the method used, the date and time and a provider reference.

We also use lawful signals to detect evasion, such as account, payment, device and network risk indicators, reports from users, parents, guardians or authorities, and behaviour suggesting an attempt to bypass the checks.

Fiara may request re-verification before or after access where:
- account behaviour is inconsistent with adult use;
- a report suggests the user or represented person may be underage;
- payment, security or fraud checks identify elevated risk; or
- a previous verification has expired or cannot be relied upon.

Failure to complete a required check may result in restricted access, suspension or account closure.

A Digital Twin may be created only of yourself, after full identity verification showing that you are an adult.
Creating a Digital Twin of any other person is prohibited.
In addition, the following are prohibited:
- creating a Digital Twin of a minor;
- using childhood, school-age or age-ambiguous source material;
- attempting to make an adult appear underage;
- using terms, clothing, settings, body characteristics or narratives intended to sexualise minors;
- generating or requesting content that resembles a minor;
- falsely claiming that an underage-looking person is an adult to evade controls.

Where age is unclear, Fiara treats the case as potentially underage, refuses generation and may require further verification.

Fiara has zero tolerance for Child Sexual Abuse Material (“CSAM”), grooming, sexual exploitation of minors, simulated or synthetic CSAM, or attempts to create such content. This applies to text, prompts, images, video, audio, character profiles and any other format.

Fiara reviews requests and generated content before display using automated detection and human review. Suspected child sexual abuse material is reported within 24 hours to the National Center for Missing & Exploited Children and to the competent authority: in the United Kingdom the Internet Watch Foundation or National Crime Agency, in Australia the eSafety Commissioner or the Australian Centre to Counter Child Exploitation, in Chile the Policía de Investigaciones. Evidence is preserved. Users involved are permanently banned and prevented from re-registering.

If Fiara reasonably suspects that an account is being used by a minor, it may:
- immediately restrict adult features or suspend the account;
- request age or identity verification;
- preserve relevant evidence;
- prevent access from associated accounts, devices or payment instruments where lawful;
- cancel active access subject to legal and payment obligations;
- delete or restrict personal data as appropriate; and
- report circumstances to competent authorities where required.

Fiara may act without prior notice where notice could increase risk, enable evasion or compromise an investigation.

Use the "Report" button on any message, image, video or voice note, or email legal@fiara.ai. Reports of suspected minors are reviewed within 24 hours.

Please provide, where available:
- the relevant username, profile, content URL or identifier;
- a description of the concern;
- screenshots or supporting information;
- your relationship to the person involved;
- a safe contact method.

Do not download, copy or redistribute suspected illegal material in order to report it. Provide a URL or identifier instead.

A parent or guardian who believes a minor has used Fiara may contact legal@fiara.ai. We may request information reasonably necessary to verify the request and locate the account. We will not disclose account content or personal data without a lawful basis.

An adult whose account was restricted due to an age concern may request review through legal@fiara.ai . Fiara may require an approved verification method before restoring access. An appeal will not restore content or access that is illegal or otherwise prohibited.
Appeals are decided within 7 business days by a person not involved in the original decision.

Conversations and content generated for you are private to your account. Content that a verified Creator chooses to publish under the Creator Program (Terms of Service, Section 4A) is reviewed by Fiara before publication and is visible only to age-verified adult users. You must not allow another person to access or control your account or AI Companion.

Attempts to evade age controls, help a minor access Fiara, submit false verification evidence or create minor-related content are serious violations and may result in permanent termination, loss of entitlements, payment restrictions and reporting to authorities.
